Posted by D. Cupples (photo from White House) | Those who consider "activist" judges and courts an anathema should remember that even a court's refusal to hear a case (i.e., lack of activity) can have a big impact on people and politics. The Hartford Courant reports:
"The U.S. Supreme Court rejected Tuesday two appeals from New Orleans property owners seeking to collect insurance payments for floodwater damage in the aftermath of Hurricane Katrina."
"The justices, without comment, left intact a federal appeals court ruling favoring units of Travelers Cos., Allstate Corp.
and other insurers. The 5th U.S. Circuit Court of Appeals said the disputed policies did not cover flooding that was caused by breached levees around the city.
"The cases are among the first to make their way to the nation's highest court since the 2005 storm devastated the city and set off a flurry of litigation over insurance coverage. (Courant)
Not all hope is lost: the Louisiana Supreme Court will hear and likely rule on the same question later this month.
